These Terms of Service ("Terms") govern your access to and use of the Jivco platform, websites, and services (the "Service") provided by Ambitions LLC ("we," "us"), operator of the Jivco service ("Jivco"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
Jivco is an AI-assisted communications platform. It connects to your business channels — such as email, SMS, online reviews, calendars, and website chat — and uses artificial intelligence to read incoming messages and generate suggested replies and related actions. You decide which channels to connect and how much the AI is allowed to do on your behalf.
You must be at least 18 years old and able to form a binding contract. You are responsible for the activity under your account, for keeping your credentials secure, and for the actions of any team members you invite. Authentication is handled through our identity provider; you agree to its sign-in requirements.
The Service is offered on a 14-day free trial and paid subscription plans. Paid plans renew automatically each billing period until cancelled. You can manage or cancel your plan from Settings → Billing; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law. We may change pricing with notice for future billing periods.

You agree that Jivco is not responsible for the consequences of content you approve, send, or allow to be sent through the Service.
You retain all rights to the data and content you connect to or create within the Service ("Customer Data"), including the personal information of your own customers that flows through the Service. You are responsible for having the rights and permissions necessary to process that data through Jivco, and for complying with all laws that apply to your communications (see our Acceptable Use Policy, including consent and anti-spam requirements). Where Jivco processes personal information on your behalf, our Data Processing Agreement applies.
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms. Misuse may result in suspension or termination.
The Service connects to third-party platforms (for example, Google, Meta, Twilio, and others). Your use of those platforms is governed by their own terms, and their availability and behavior are outside our control. We are not responsible for changes, outages, or restrictions imposed by third-party platforms, including the loss of an integration's functionality.
The Service, including its software, design, and content (excluding Customer Data), is owned by Jivco and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You may not copy, reverse engineer, resell, or build a competing product from the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT AI OUTPUT WILL BE ACCURATE, RELIABLE, OR ERROR-FREE. We do not warrant that the Service will be uninterrupted or that any message will be delivered, captured, or replied to.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JIVCO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, LOST BUSINESS, LOST DATA, OR DAMAGES ARISING FROM AI-GENERATED CONTENT OR MESSAGES SENT THROUGH THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
You agree to indemnify and hold Jivco harmless from claims arising out of your Customer Data, your communications, your violation of these Terms or applicable law, or content you sent or approved through the Service.
You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms, non-payment, or risk to the Service or others. On termination, your right to use the Service ends; data handling on termination is described in the Privacy Policy and DPA.
We may update these Terms. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Continued use after changes take effect means you accept the revised Terms.
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-laws rules.
